3. Definitions

3.1 For the purposes of this Policy, the following terms shall be defined as follows:
3.1.1 Information relating to the race, gender, sex, pregnancy, marital status, national, ethnic or social origin, color, sexual orientation, age, physical or mental health, well-being, disability, religion, conscience, belief, culture, language, and birth of the person;
3.1.2 Information relating to the education or the medical, financial, criminal, or employment history of the person;
3.1.3 Any identifying number, symbol, e-mail address, physical address, telephone number, location information, online identifier, or other particular assignment to the person;
3.1.4 The biometric information of the person;
3.1.5 The personal opinions, views, or preferences of the person;
3.1.6 Correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence;
3.1.7 The views or opinions of another individual about the person;
3.1.8 and The name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person.

3.2 “Applicable Law” means all national or international (where applicable) statutes, laws, ordinances, rules and regulations, including but not limited to any license, permit or other governmental authorisation imposing liability or setting standards of conduct concerning any environmental, social, labour, health and safety or security risks pertaining to this Notice;

3.3 "Data Protection Laws" means any and all applicable worldwide legislation relating to data protection, privacy, data security and Personal Data applicable to a Party when Processing Personal Data under this Agreement and shall include but not limited to:
3.3.1 the Protection of Personal Information Act 4 of 2013 (“POPIA”);
3.3.2 to the extent applicable, the European Union General Data Protection Regulation 2016/679 (“GDPR”) and laws implementing or supplementing the GDPR;
3.3.3 to the extent applicable, the Gramm-Lach-Bliley Act of 1999;
3.3.4 to the extent applicable, the UK Data Protection Act of 2018;
3.3.5 and to the extent applicable, any other data protection law that may apply in a specific Client jurisdiction.

3.4 “Personal Information” means any personally identifiable information(“PII”) identifying and describing an identifiable individual, including, but not limited to information relating to their name, age, gender, reproductive status, marital status, national, ethnic or social origin, sexual orientation, physical or mental health, disability, conscience, belief, culture, language and birth of the individual; educational, criminal or employment history of the individual, financial status or information relating to financial transactions in which they have been involved and any identifying number, address or contact information of the individual;

3.5 "Processing" means 'processing' as defined in the Data Protection Laws, which includes any operation or activity concerning personal information, such as collection, recording, storage, and more.

3.6 "Website" means the Direct Transact website hosted at directtransact.co.za.

3.7 "You" or "User" means any person who accesses and uses the Website for any reason.

4. Personal information collected

4.1 The Personal Information that we may process includes your name and surname, e-mail address, contact information, information relating to your occupation, and personal information contained in your curriculum vitae (CV) that You may submit as part of the job application process, such as your physical address, postal address, identity or passport numbers, and employment history. We also collect details of the pages of the Website viewed by You.

4.2 We will limit the Personal Information we process to only that which You consent to and which is necessary for our legitimate business interests.

5. Collection & accuracy of Personal Information

5.1 Personal information will be processed when You complete the relevant online forms on the Website.

5.2 By using the Website, You consent to your Personal Information being processed and stored by Direct Transact for the purposes specified in this Notice.

5.3 While Direct Transact makes every effort to ensure the integrity and accuracy of your Personal Information, there may be times when this is not possible. Therefore, You accept responsibility for the accuracy of the Personal Information You provide to Direct Transact and for keeping it up to date. Please inform Direct Transact of any changes to your Personal Information.

5.4 If You find any inaccuracies in your Personal Information, You have the right to request corrections. Please contact us using the information provided in the "Enquiries" section of this Notice.

6. Purpose for which your Personal Information is collected

6.1 We will only use the Personal Information You provide for the following purposes:
6.1.1 For Contact Form users, processing the relevant online application or registration form.
6.1.2 For Job Applicants, processing the relevant job application and retaining it for future recruitment processing.

6.2 If the specific purpose for which your Personal Information is collected differs from what is specified in paragraph 6.1, we will communicate that purpose to You when the information is requested.

6.3 Direct Transact will only process Personal Information for a purpose consistent with the purpose for which it is collected and to which You have consented.

6.4 The Electronic Communications and Transactions Act 25 of 2002 permit us to use Personal Information collected to compile profiles for statistical purposes. No information in the profiles or statistics will be linked to any specific user.

7. Sharing of your Personal Information

7.1 We will only disclose your Personal Information to a third party with your written consent or as required by law for government and law enforcement agencies.

8. Your rights

You have the right, by written notice to the Direct Transact Information Officer, to:

8.1 Object to the processing of your Personal Information at any time, on reasonable grounds, unless the processing is required by law.

8.2 Withdraw your consent for Direct Transact to process your Personal Information at any time.

8.3 Request that we correct, destroy, or delete any of your Personal Information that Direct Transact has processed in accordance with this Notice.

9. Retention & deletion of your Personal Information

9.1 Direct Transact will not retain your Personal Information longer than is necessary for the purpose for which it was initially collected or subsequently processed unless required by law.

9.2 If You request it, Direct Transact will delete or anonymize your Personal Information so that it no longer identifies you, unless we are legally allowed or required to maintain certain personal data for specific purposes.
